Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and The Sixth Collection, LLC, a Washington limited liability company trading as Conductor ("Conductor", "we", "us", or "our"). They govern your access to and use of the Conductor mobile application, website, and any related services (collectively, the "Service").

By downloading, installing, creating an account, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree, you must not use the Service.

We may update these Terms from time to time. We will give you reasonable notice of material changes through the app or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. The current version is always available within the app and at conductorapp.co.uk.

2. Description of the Service

Conductor is a real-time train tracking and journey management application. It aggregates live and historical train status information, journey history, delay intelligence, routing, and related travel utilities sourced from licensed national and international rail data feeds and infrastructure.

Conductor is not a rail operator, ticket retailer, government transport authority, or official source of timetable information. We do not sell, issue, or validate travel tickets. All ticketing, timetable, and operational matters remain solely under the authority of the relevant operator or national transport body.

The Service is provided for personal, non-commercial informational purposes. It is designed to assist you in monitoring and planning your rail journeys and is not a substitute for official operator communications, station departure boards, or any other authoritative source of travel information.

3. Eligibility and Account Registration

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service and agree to these Terms.

To access certain features you must create an account. You agree to provide accurate, complete, and current information at registration and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

If you suspect any unauthorised access to your account, notify us immediately at support@conductorapp.co.uk. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in breach of these Terms.

4. Subscriptions and In-App Purchases

Conductor offers optional premium subscription plans ("Conductor Pro") that unlock additional features. Subscriptions are offered on a recurring basis (monthly or annual) and are processed exclusively through the Apple App Store. By subscribing, you authorise Apple to charge your Apple ID account on a recurring basis at the applicable rate until you cancel.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription at any time in your Apple ID account settings under Subscriptions. Cancellation takes effect at the end of the current paid period; no partial refunds are issued for unused time within a period.

All billing disputes, refund requests, and subscription management must be handled through Apple in accordance with Apple's App Store policies. We have no ability to process or override refunds on Apple's behalf.

We reserve the right to adjust subscription pricing with reasonable advance notice. Continued use of your subscription following a price change constitutes acceptance of the new price.

5. Licence Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Conductor app on Apple devices that you own or control, solely for your personal, non-commercial purposes.

You may not: (a) copy, modify, distribute, sell, sublicense, or create derivative works of any part of the Service; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of the Service or any component thereof; (c) access or use the Service in any way that could damage, disable, overburden, or impair our systems or networks; (d) use automated tools, bots, scrapers, or scripts to access, collect, or extract data from the Service without our prior written consent; (e) use the Service for any commercial purpose, data resale, or aggregation service without our prior written consent; or (f) circumvent, disable, or interfere with any security or access-control feature of the Service.

All rights not expressly granted in these Terms are reserved by The Sixth Collection, LLC.

6. Intellectual Property

All content, features, functionality, design elements, trademarks, trade names, logos, proprietary algorithms, and software comprising the Service are and remain the exclusive property of The Sixth Collection, LLC or its licensors and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any rights in or to our intellectual property other than the limited licence in Section 5. You agree not to challenge our ownership of or rights in any of our intellectual property.

7. Third-Party Trade Marks and Data Attributions

Conductor displays the names, logos, and branding of train operating companies and transport authorities solely to identify the relevant operator of a service. All such names, logos, and branding are the trade marks or registered trade marks of their respective owners. Their display within the Service does not imply any affiliation with, endorsement by, or sponsorship of Conductor by those operators or authorities.

Rail timetable, live performance, and historical data is sourced under licence from Network Rail and the Rail Data Marketplace. Such data is the intellectual property of its respective owners and is used in accordance with the applicable licence terms. The National Rail name and logo are trade marks of the Rail Delivery Group.

Maps within the Service are powered by Mapbox. Map data includes contributions from OpenStreetMap contributors and is used under the Open Database Licence (ODbL). © Mapbox. © OpenStreetMap contributors.

European routing data is provided via MOTIS, an open-source multi-modal routing framework. MOTIS is copyright © the MOTIS Project contributors and is used under the MIT Licence.

Operator logo images displayed in the Service are fetched from publicly accessible sources and remain the property of their respective brand owners. Conductor claims no ownership of any third-party logos.

8. Delay Intelligence and Accuracy Disclaimer

Conductor provides delay intelligence, predicted arrival and departure times, platform information, and related journey status data as a convenience to users. This information is derived from real-time and historical rail data feeds and is subject to inherent uncertainty and latency.

All such information is provided strictly 'as is' and without any warranty of accuracy, timeliness, or completeness. Rail operations are subject to factors entirely outside our control, including engineering works, infrastructure incidents, operational disruptions, staffing, weather events, and data feed outages, any of which may cause information displayed in the Service to differ from operational reality.

You must not rely on Conductor as your sole source of travel information. You are solely responsible for verifying all travel information through official channels — including station departure boards, the relevant operator's app or website, and rail staff — before making any journey decision. We are not responsible for any journey missed, connection failed, or other adverse travel outcome arising from reliance on information provided by the Service.

9. Feedback and User Submissions

If you submit ideas, suggestions, corrections, or other feedback to us ('Feedback'), you grant The Sixth Collection, LLC a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, and incorporate that Feedback into the Service or other products without any obligation to you. We are not obliged to treat Feedback as confidential or to compensate you for it.

10. Third-Party Services and Links

The Service integrates with and may link to third-party services, including mapping providers, authentication services, cloud infrastructure, and rail data providers. These services are governed by their own terms and privacy policies, and we have no responsibility or liability for their content, practices, security, or continuity.

Third-party integrations and links are provided for functionality or convenience only and do not constitute an endorsement by Conductor.

11. Export Controls and Sanctions Compliance

The Service is subject to the export control laws and regulations of the United States and other applicable jurisdictions. You represent that you are not located in, under the control of, or a national or resident of any country subject to a US government embargo or designated as a 'terrorist supporting' country, and that you are not listed on any US government list of prohibited or restricted parties.

You agree not to use, export, re-export, or transfer the Service or any component thereof in violation of any applicable export control law or regulation.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components, or that any defects will be corrected. We do not warrant the accuracy, completeness, or timeliness of any train information, delay prediction, or routing data displayed in the Service.

Nothing in these Terms affects any statutory rights you may have that cannot lawfully be excluded or limited, including under the Consumer Rights Act 2015 if you are a consumer in the United Kingdom, or equivalent consumer protection legislation in your jurisdiction.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SIXTH COLLECTION, LLC (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This exclusion covers, without limitation, any loss of profits, loss of revenue, loss of data, missed rail connections, travel costs incurred, accommodation costs, event or ticket costs, or other economic or consequential losses resulting from your use of or reliance on the Service.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) TWENTY-FIVE UNITED STATES DOLLARS (USD $25).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING UNDER SECTION 31 OF THE CONSUMER RIGHTS ACT 2015 IF YOU ARE A CONSUMER IN THE UNITED KINGDOM.

Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions our liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless The Sixth Collection, LLC and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms; (b) your use or misuse of the Service; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content or data you submit or transmit through the Service.

15. Force Majeure

We will not be liable to you for any failure or delay in performing our obligations under these Terms where that failure or delay results from circumstances beyond our reasonable control. This includes, without limitation, acts of God, natural disasters, pandemic or epidemic events, strikes or industrial action (including by rail operators or data providers), power or telecommunications failures, government orders, cyberattacks or distributed denial-of-service attacks, or failure of third-party data feeds or infrastructure on which the Service depends.

If such an event occurs, we will take reasonable steps to resume performance as soon as practicable.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if we determine it necessary to protect the Service, other users, or third parties.

You may stop using the Service and delete your account at any time through the app settings or by contacting support@conductorapp.co.uk. Deleting your account will trigger deletion of your personal data in accordance with our Privacy Policy.

On termination, the licence granted to you under Section 5 ceases immediately. Sections 6, 7, 9, 12, 13, 14, 17, and 19 survive termination.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. This choice of law does not affect any mandatory consumer protection rights you hold under the law of the country in which you reside.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Subject to the exceptions below, you and The Sixth Collection, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, rather than in court. Arbitration proceedings will be conducted in Spokane, Washington, or by telephone or written submission.

YOU AND THE SIXTH COLLECTION, LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR CLASS ARBITRATION. Claims may only be brought in an individual capacity.

Either party may bring an individual claim in a small claims court of competent jurisdiction if that claim qualifies. We will not seek to compel arbitration of any claim you bring in small claims court so long as the claim remains there.

If you are a consumer resident in the United Kingdom or a European Economic Area member state, the mandatory arbitration and class action waiver provisions above do not apply to you to the extent prohibited by applicable local law. In that case, disputes will be subject to the non-exclusive jurisdiction of the courts of your country of residence, and you retain any mandatory statutory rights to bring proceedings in your local courts.

18. Apple App Store — Additional Terms

These Terms are between you and The Sixth Collection, LLC only. Apple Inc. is not a party to these Terms and bears no responsibility for the Service or its content.

The licence granted in Section 5 is limited to use on Apple-branded devices you own or control and is subject to the Usage Rules in Apple's App Store Terms of Service.

Apple has no obligation to provide maintenance or support for the Service. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service. If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); beyond that Apple has no further warranty obligation.

Apple is not responsible for addressing any claims relating to the Service, including product liability claims, consumer protection claims, intellectual property claims, or any claims under applicable law.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.

19. Open Source Software

The Service incorporates open source software components. A full list of open source components used in the iOS app, together with their applicable licence texts, is available within the app at Settings > About > Acknowledgements.

Key open source components include: MOTIS (multi-modal routing, MIT Licence, © MOTIS Project contributors); Mapbox Maps iOS SDK (Mapbox Terms of Service, © Mapbox); Supabase Swift client (MIT Licence, © Supabase); and various Node.js and web libraries (MIT and Apache 2.0 Licences). Where a licence requires reproduction of its copyright notice, that notice is included in the Acknowledgements screen referenced above.

Map data is provided by OpenStreetMap contributors under the Open Database Licence (ODbL). © OpenStreetMap contributors. If you use any map data obtained through the Service, you must attribute OpenStreetMap in accordance with the ODbL.

20. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Sixth Collection, LLC regarding the Service and supersede all prior agreements and understandings on that subject.

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable; the remaining provisions continue in full force.

Our failure to enforce any right or provision is not a waiver of that right or provision.

You may not assign any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including to a successor entity in a merger or acquisition.
